Class Action Lawsuits
In the 1970's the onslaught of Asbestos lawsuits began. The target of the class action lawsuits have been shipbuilders, manufacturers, mining companies and construction companies. Because many of these buildings/mines/ships still stand mesothelioma and of course mesothelioma class action lawsuits continue. Mesothelioma causes death so you would think that the reward should be substantial.
Generally real property defined as land and the things permanently attached to the land. Things that are permanently attached to the land, also can be referred to as improvements, including homes, garages, and buildings. Substances that are beneath the land (such as gas, oil, minerals) are also considered permanently attached. Other items which can be attached to the land, such as mobile homes and tool sheds, are not considered to be real property.
When you own a real property you have legal rights and you are allowed to do whatever you want with the land, but these rights are subject to restrictions imposed by law. When you own land, you can personally use it, you can also rent or lease it to others, you can sell or transfer it, or you can give it away, you can use it as collateral for a loan, give it to intended beneficiaries either by will or trust upon your death, or let it sit where it is without doing anything to it. However this last option could create problems because of restrictions imposed by law.
Indeed there are numerous federal, state, county and local regulations, which in fact restrict what you can do with the real property that you own. Enforcement of these laws typically resides with various governmental agencies which are responsible for keeping you in compliance with these laws.
There are three most common restrictions imposed by government are. First the use of your real property as to residential, industrial, agricultural, or commercial purposes depend of the zoning. You cannot build a factory in a residential are for example. Besides the size and height of improvements attached to the property are commonly subject to restriction. Second you are not allowed to stored dangerous substances on the real property and you are also responsible for removing environmental hazards from real property. Third you have to leave a portion of the real property open for others to use. Easements and right of way are used to allow access to other property, to provide for roads and sidewalks.
